2. Acceptance of these terms

By creating an account, listing a venue, making a booking, or otherwise using Trainer Space, you agree to these Terms of Use and our Privacy Policy.

If you do not agree to these terms, you must not use Trainer Space.

3. What Trainer Space does

Trainer Space is a marketplace platform that allows trainers, class instructors, and other fitness professionals to search for and book gym, studio, clinic, and training spaces by the hour.

Venues can list rooms or spaces, manage availability, receive bookings, and receive payouts through Stripe Connect.

4. Marketplace role

Trainer Space facilitates bookings between trainers and venues. Unless expressly stated otherwise, Trainer Space is not a party to the agreement between a trainer and a venue for use of a space.

Venues are responsible for the accuracy, safety, access, cleanliness, suitability, and lawful operation of their listed spaces. Trainers are responsible for their own professional conduct, clients, qualifications, insurance, and compliance with venue rules.

5. Eligibility and accounts

• You must be at least 18 years old to use Trainer Space.
• You must provide accurate account, profile, venue, and booking information.
• You are responsible for keeping your login details secure.
• You are responsible for activity carried out through your account.
• We may suspend or restrict accounts where we suspect misuse, fraud, breach of these terms, or risk to users or the platform.

6. Bookings

• A booking is confirmed when payment is successfully processed and Trainer Space records the booking as confirmed.
• Availability may change and can be affected by venue rules, room availability, booking capacity, and venue block-outs.
• Trainers must use the booked space only for lawful and permitted activities.
• Trainers must arrive and leave on time.
• Trainers must comply with venue-specific rules, access instructions, and reasonable venue requirements.

7. Payments

Trainer payments are processed online through Stripe Checkout. Trainer Space does not store full card details.

Venue payouts are handled through Stripe Connect. Venues are responsible for completing any required Stripe onboarding steps before payouts can be made.

Prices and applicable fees will be shown before checkout where possible. Trainer Space may introduce or amend platform fees in future, and any such fees will be disclosed before payment where applicable.

8. Cancellations and refunds

Cancellations and refunds are governed by our Cancellation and Booking Policy.

In summary: trainers may cancel before the booking start time, but Stripe processing fees may be deducted from trainer refunds. If a venue cancels, the trainer should receive a full refund, and the venue may be responsible for the Stripe processing fee.

9. Venue responsibilities

• Provide accurate venue, room, pricing, access, availability, and contact information.
• Maintain a safe, clean, suitable, and lawful environment for bookings.
• Manage availability and block-outs accurately.
• Comply with applicable laws, insurance obligations, licences, and health and safety requirements.
• Ensure trainers can reasonably access the booked space during the confirmed booking time.

10. Trainer responsibilities

• Provide accurate profile and contact details.
• Use spaces respectfully and only for permitted activities.
• Arrive and leave on time.
• Respect venue rules, access instructions, staff, other users, and equipment.
• Ensure you have any required qualifications, permissions, insurance, and professional standards for the services you provide.
• Take responsibility for your own clients and any services you provide to them.

11. Prohibited use

• Illegal, harmful, abusive, unsafe, or fraudulent activity.
• Harassment, discrimination, threatening behaviour, or abusive conduct.
• Attempting to bypass Trainer Space payments, booking controls, or security systems.
• Uploading misleading, unlawful, offensive, or infringing content.
• Misrepresenting your identity, qualifications, venue, availability, or services.
• Interfering with the operation, security, or reliability of Trainer Space.

12. Content and intellectual property

You retain ownership of content you upload, such as venue images, trainer images, profile text, and venue information.

You grant Trainer Space a non-exclusive licence to host, store, display, reproduce, and use that content as needed to operate, promote, maintain, and improve Trainer Space.

The Trainer Space platform, branding, software, design, layout, and intellectual property are owned by Trainer Space Ltd or its licensors.

13. Reliability information

Trainer Space may display or use booking, cancellation, reliability, verification, or status information to help users assess bookings and manage risk.

We may record late cancellations, venue access issues, or other reliability events where relevant to platform operation.

14. Disclaimers

Trainer Space is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, error-free functionality, or that all listings will always be accurate or available.

We do not provide fitness, medical, legal, financial, insurance, or health and safety advice.

We are not responsible for the acts or omissions of trainers, venues, venue staff, clients, or other third parties.

15. Liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, Trainer Space’s liability is limited to the maximum extent permitted by law.

16. Suspension and termination

We may suspend, restrict, or terminate access to Trainer Space if we believe a user has breached these Terms, created risk, misused the platform, acted fraudulently, or caused harm to other users or Trainer Space.

17. Changes to these terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use of Trainer Space after changes take effect means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer rights.
